1. Acceptance of Terms
By downloading, installing, or using the nestspace mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and nestspace ("Company", "we", "us", "our").
If you do not agree to these Terms, do not use the App. We reserve the right to modify these Terms at any time. Continued use after changes constitutes acceptance.
2. Description of Service
nestspace is a property rental marketplace that connects:
- Tenants looking for rental accommodation in Pune, Maharashtra
- Property owners listing entire flats or rooms for rent
- PG owners listing paying guest accommodation
- Brokers/agents listing properties on behalf of owners
nestspace is a platform connecting parties — we are not a real estate agent, broker, or property manager, and we do not own any of the listed properties.
3. Eligibility
To use nestspace, you must:
- Be at least 18 years of age
- Have a valid Indian mobile phone number for OTP verification
- Provide accurate and truthful information during registration
- Not be prohibited from using the App under applicable law
4. User Accounts
4.1 Account Registration
You must register using your mobile phone number verified via OTP. You are responsible for maintaining the confidentiality of your account and all activities under your account.
4.2 Account Types
- Tenant: Can search listings, save properties, message owners, and reveal contact details
- Property Owner / PG Owner: Can post and manage listings, receive inquiries
- Broker/Agent: Can post listings on behalf of property owners
4.3 Account Termination
We reserve the right to suspend or terminate accounts that violate these Terms, post fraudulent listings, engage in spam or harassment, or misuse the platform.
5. Listing Rules for Owners and Brokers
5.1 Accuracy
All property listings must be accurate, truthful, and current. You must not:
- Post properties you do not own or have authority to list
- Use misleading photos (photos must be of the actual property)
- Post fake or duplicate listings
- List properties in areas not currently served by nestspace
5.2 Listing Limits
Free plan users may post up to 2 active listings. Paid plan limits vary by subscription tier. Listing limits are enforced per account.
5.3 Prohibited Listings
The following are strictly prohibited on nestspace:
- Properties with illegal occupancy or without proper ownership/authorization
- Listings targeting only specific religions, castes, or ethnicities (violation of Indian anti-discrimination law)
- Properties used for illegal activities
- Commercial properties (nestspace is for residential rental only)
6. Contact Reveal and Communication
nestspace provides a contact reveal feature where tenants can access owner phone numbers. By posting a listing, owners consent to their verified phone number being shared with genuine tenants through this feature. Tenants must use contact information only for legitimate rental inquiries and must not use it for spam, harassment, or commercial solicitation.
7. Payments and Subscriptions
7.1 Paid Plans
nestspace offers paid subscription plans for brokers/PG owners (listing boosts, additional listings) and contact credit packs for tenants. All prices are in Indian Rupees (INR) and inclusive of applicable GST.
7.2 Payment Processing
Payments are processed through Razorpay. By making a payment, you agree to Razorpay's Terms of Service. We do not store your payment card or bank account details.
7.3 Refund Policy
Subscription fees and listing boost payments are non-refundable once the service has been activated. Contact credit packs are non-refundable once credits have been used. If you experience a technical issue with payment, contact support@nestspaceindia.com within 48 hours.
7.4 Auto-Renewal
Subscription plans do not auto-renew. You must manually renew at the end of your subscription period.
8. Prohibited Conduct
You agree not to:
- Post false, misleading, or fraudulent content
- Harass, threaten, or abuse other users
- Scrape, copy, or extract data from the App
- Attempt to circumvent subscription limits or payment requirements
- Use automated bots or scripts to interact with the App
- Impersonate another person or entity
- Post content that is defamatory, obscene, or violates any law
- Discriminate against users based on religion, caste, gender, or any protected characteristic
9. Intellectual Property
The nestspace name, logo, App design, and all content created by us are our intellectual property. You may not copy, reproduce, distribute, or create derivative works without our written permission. User-generated content (listings, photos) remains the property of the user. By posting content, you grant nestspace a non-exclusive, royalty-free license to display and promote your listing within the App.
10. Disclaimers
nestspace is a marketplace platform. We do not:
- Verify the accuracy of all property listings
- Guarantee the quality, safety, or legality of listed properties
- Endorse any specific owner, broker, or tenant
- Take responsibility for disputes between users
We strongly recommend verifying all property details in person before making any payment or signing any agreement.
11. Limitation of Liability
To the maximum extent permitted by applicable Indian law, nestspace shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App, including but not limited to rental disputes, property damage, financial loss, or personal injury.
Our total liability to you for any claim arising out of these Terms shall not exceed the amount you paid to nestspace in the 3 months preceding the claim.
12. Governing Law and Dispute Resolution
These Terms are governed by the laws of India. Any disputes arising from these Terms or your use of nestspace shall be subject to the exclusive jurisdiction of the courts in Pune, Maharashtra, India.
We encourage users to first attempt to resolve disputes through our support team at support@nestspaceindia.com before pursuing legal action.
